DESCRIPTION This course aims to familiarise students with the law applying to international financial markets and the newly emerging markets for crypto-assets. Financial and crypto markets are governed by a plethora of different rules, both of regulatory law and private law. Understanding which rules govern a specific operator, transaction, or activity is crucial to avoid legal pitfalls and liability. Participants will gain a solid theoretical foundation and practical skills for navigating various parts of the financial market, including offerings of new crypto-assets and the regulatory landscapes of Switzerland, the EU, and the U.S. They will develop an understanding of the rules governing global secondary markets, comprehend the complexities of the global post-trade market—where the laws of different legislators and regulators can collide and interact—and learn how international organisations address systemic risks. Readings from diverse jurisdictions will complement the learning, preparing the participants for the intricacies of international financial regulations.
